Terms

1. EQUIPMENT, RENT & TERMS OF RENTAL AGREEMENT:

   The undersigned, as Lessee, hires from Aussie Outdoor Cinemas and its parent Yellow Citrine Pty Ltd t/as Aussie Outdoor Cinemas.

2. DELIVERY:

   To the street address specified by the Lessee (Customer). The Lessee grants Lessor right to enter the property at the said address (“Delivery Address”) for the delivery and subsequent pick up of Aussie Outdoor Cinemas equipment at the specified time.

3. TRANSPORTATION EXPENSE:

   Except as provided herin, all charges in delivering and subsequent pick up of Aussie Outdoor Cinemas equipment with respect to the Delivery Address are included in the Rental Fee noted. In the event that Aussie Outdoor Cinemas equipment is not returned at the appointed time by Lessee to Lessor then $50 Transportation Fee shall be automatically imposed.

4. MAINTENANCE:

   Lessee agrees to keep Aussie Outdoor Cinemas equipment in the same condition as when received, ordinary wear expected.

5. TITLE TO:

   Lessee agrees to keep Aussie Outdoor Cinemas equipment in his/her custody not to sublease, rent, sell, remove from the Delivery Address, or otherwise transfer such unit. Aussie Outdoor Cinemas equipment will remain the property of the Lessor and may be removed from the Lessor at any time after the termination of this Rental Agreement.

6. RELEASE OF LIABILITY:

   The Lessee shall be in charge of Aussie Outdoor Cinemas equipment limited to Home Handi Package only , and is fully responsible for its operation as well as return of Aussie Outdoor Cinemas equipment limited to Home Handi Package only in good working order. Lessor and its officers, employee and agents is/are not responsible for injury occuring to the Lessee or any other persons using Aussie Outdoor Cinemas equipment, and the Lessee further agrees to hold the Lessor and its officers, employees and agents free and harmless against any injury or claims. The Lessee shall indemnify the Lessor and its officers, employee and agents from/against any costs incurred due to claims from anyone and for attorney’s fees and related costs involving the use and return of Aussie Outdoor Cinemas equipment, should legal action become necessary. Aussie Outdoor Cinemas will not be held responsible for stoppage or service or damages due to causes out of its control including, without limitation, breakdowns, bad weather or site conditions. It is the responsibility of the Lessee to provide a suitable environment, and for daytime events, fully shaded from the sun light for Aussie Outdoor Cinemas to provide service. In the event of an unsuitable environment as deemed by Aussie Outdoor Cinemas being present, Aussie Outdoor Cinemas have the right to decline service, with no compensation to the lessee.

7. ENTIRE AGREEMENT:

   The Rental Agreement constitutes the full agreement between Lessor and Lessee. Time is of the essence in this Rental Agreement. The receipt of Aussie Outdoor Cinemas equipment that is the subject of this Rental Agreement is in good working order and repair and this is so acknowledged by Lessee.
